He has litigated cases involving consumer disputes, contracts, personal injury, wrongful death, insurance claims and disputes, federal and state constitutional law claims, civil rights, labor & employment claims, religious discrimination, sexual harassment and hostile work environment, real estate disputes, oil and gas disputes, environmental issues and banking matters. He has tried more than 50 cases to verdict/judgment and has argued or appeared in more than 20 appellate cases before state and federal appellate courts, including the U.S. Fifth Circuit Court of Appeals and the United States Supreme Court.

In 1989, Mr. Peña joined the Southwestern Bell Telephone Company Legal Department. For more than 29 years, Mr. Peña personally tried more than 85 highly specialized labor arbitrations ranging from contract interpretation and special interest grievances to just cause suspensions or dismissals.

He currently serves as an arbitrator on the American Arbitration Association Employment Panel and as a public arbitrator for FINRA

    Rates & Locations for Arbitrations 1. The fee for each day of hearing is $1,250. The fee for study time and writing the opinion is $1,250 per day. Study time and writing the opinion is billed in half-day increments. One half-day is 3.5 hours. 2. A cancellation/postponement fee of $1,250 per day will be charged for all scheduled hearing days if the hearing is cancelled or postponed within 30 calendar days prior to the day of the hearing. (The day of the hearing is not counted.) 3. There is no travel charge for hearings that take place in the Dallas/Fort Worth area (Dallas, Tarrant, Denton and Collin Counties). If travel expenses are incurred (e.g., airplane, Uber/taxi, airport parking, hotel and meals) such expenses will be charged split among the parties based on prior arrangement. Travel expenses will be charged from the Arbitrator’s Fort Worth office address. 4. If the hearing is cancelled or postponed, the parties are responsible for fees charged by a hotel for a cancellation beyond the deadline. 5. Willing to conduct pro bono arbitration or mediation on a case by case. Rates & Locations for Mediations Expedited 2 hour Mediation Session – This option is available for two-party cases (other than family law matters). Two hour mediation sessions are charged at a rate of $400 per party (2 party cases only). 3 hour Mediation Session – This option is available for two-party cases (other than family law or multi-party disputes). The preferred times for scheduling these sessions is: • 10:00 a.m. to 1:00 p.m. • 1:00 p.m. to 4:00 p.m. • 2:00 p.m. to 5:00 p.m. Three hour mediation sessions are charged at the rate of $575 per party (2 party cases only). 4 Hour Mediation Session – This option is available for two-party cases and multiparty cases. The preferred times for scheduling these sessions is: • 9:30 a.m. to 1:30 p.m. • 2:00 p.m. to 6:00 p.m. Subject to the needs of the parties, deviations from these preferred times can be scheduled, depending upon the mediator’s schedule. Four hour mediation sessions are charged at the rate of $675 per party. Full day Mediation Session – This option is available for two-party cases and multiparty cases. The Pena Arbitration & Mediation Group will provide the parties lunch. The preferred time for scheduling a full day session is: • 9:30 a.m. to 5:30 p.m. The Mediator is open to starting earlier or later, depending on the complexity of the case, the parties’ travel schedule or any other circumstances. Full day mediation sessions are charged at the rate of $1,300 per party. The Mediator is committed to working on the case after 5:30 p.m. and into the evening if necessary. The parties will not be charged for the first hour after eight hours. Additional hours after the eighth hour will be charged at the rate of $375 per hour to be split among the parties. Payment – All mediation fees are due seven days in advance of a scheduled mediation via credit card payment or law firm check. Checks are to be made out to the Pena Arbitration & Mediation Group. Travel – The Pena Arbitration & Mediation Group does not charge for travel for mediations. For complex business or oil & gas disputes in locations more than 100 miles beyond Fort Worth, Texas, unless other arrangements are made, a travel per diem of not more than $100 per day may be charged. Cancellation Fees – The Pena Arbitration & Mediation Group will not charge cancellation fees for mediations cancelled at least 24 hours prior to the scheduled session. Cancellation fees will not exceed $150
