- A: You can get therapy even if you refuse to return to work, which only really affects to getting work comp checks. However, before you refuse the job that was offered, I'd highly recommend that you speak to an attorney licensed to practice law in Florida and who handles workers' compensation cases to talk about your options.
- Q. If I injured something directly due to a workers comp injury is that new injury also covered under workers comp?
- A: Very good question! This would, most likely, fall under the initial date of accident with the insurance company, even though it's, technically, a new accident. If this new injury happened while working, it could either be a new injury or fall under the original accident. Either way, you should be covered, but I anticipate that work comp may give you some trouble, especially if your asserting that your new injury was caused by overuse/overcompensation for the original injury. As such, I highly recommend that you contact an attorney licensed to practice law in Florida and who regularly handles workers' compensation cases to help you with this.
- Q. Can a lawyer review my personal injury case that my lawyer refused to take to trial?
- A: I'm not sure what you mean by review, but if you mean hire a new attorney - yes you can. Attorneys differ in opinions, but the fact that your first attorney did not want to take the case to trial is a red flag for any new attorneys. I'd recommend that you consult with an attorney licensed to practice law in Florida and who regularly handles personal injury cases.
