- A: Personal injury proceeds received on behalf of a child are the property of the child, not the parents, and should only be spent on behalf of the child. Generally, if the recovery is over $15,000, the law requires that the settlement be court approved, and the court orders that the funds go into a Federally insured interest bearing account. If court approved, the money usually cannot be withdrawn without an order from the court agreeing that the expense is int he child's best interest. If the recover is under $15,000 it does not have to be court-approved, and the money can be withdrawn without court order, but the rules are otherwise the same. Depending on whether you live inside or outside of a city court jurisdiction, this could be a city court, justice of the peace court, or the small claims ("clerk's docket") of your parish district court.
