- Q. I have a Book trademarked in Australia, does it also work worldwide and in the USA or do I have to have a US trademark?
- A: In order to have protection in the US a Trademark must be filed in the United States with the USPTO. An Australia trademark does not protect you worldwide or outside the registered country.
- Q. What do I need to move forward on a trademark.... I need an attourney
- A: In order to move forward with a trademark you must file an in-use or intent-to-use application with the USPTO. It is recommend to do a quick search of the USPTO to check if your potential trademark is already in use. It is recommended but not required to work with a Trademark Attorney or Specialist to help guide you through the process of navigating the USPTO and to allow you to have the most optimal chance of a successful application and registration.
- Q. This trademark for Crow expired in 1988, can I now trademark it?
- A: If the trademark expired you are free to register a new application for the mark. However, it is recommended to work with a trademark attorney to conduct a trademark search for similar or existing marks prior to filing for the trademark application.
