Biography

My practice is a holistic one. Rockaway is a small exurban town. As such, a certain neighborly attitude is required which includes pro bono work, volunteerism and maintaining ones reputation as a fair, just, and equitable advocate among clients and the community. There is also time to play and enjoy doing things that are of interest. I volunteer in a local soup kitchen, shoot skeet (but not hunt), and study Americana. I especially enjoy my six grandchildren who reside nearby. I am a graduate of Boston Latin ('60), Boston University ('64), Rutgers Law School ('67), and studied ASL (American Sign Language) and Deaf culture at Union County College.

Q. If I rent room in private house with many rooms ( nj state) Can I put lock in my door?
A: The first question is whether this is a legal unit.

Did the Landlord give occupancy permit which includes a smoke detector certification?

Is there a written lease? Did you pay a security deposit? Did the Landlord provide you with the name of the bank where the deposit is being held? In any event, you may lock the door. All leases in NJ, both written or oral, is deemed to include the provision for quiet enjoyment which limits the right of the Landlord to enter your unit without notice except for an emergency such as a water or gas leak.

A: The issues involve whether the survey you have or the one the neighbor has is correct. There is also the issues of adverse possession and prescriptive easement. The proofs involve you and your predecessor in title can show the the use was adverse or hostile, exclusive, visible, uninterrupted and continuous foe a period of time not less than twenty years. You should speak to an experienced real estate attorney.
Q. i signed a contract but wasnt able to attend any of the classes i signed up for, can i get a refund?
A: Your right to a refund should be outlined in the contract and/or supplemental documents supplied prior to signing the contract. Once the contract is signed new terms cannot be included unless the orginal documents permit this.
