Ryan Hyde is an experienced criminal defense attorney and former prosecutor. In addition to handling hundreds of DUI cases through all stages of trial Ryan served as a DUI ARD Coordinator and as one of lead attorneys on Economic Crimes, Arson Crimes and Special Investigations Unit. Ryan has investigated and prosecuted dozens of complex economic crime cases, including securities fraud, political corruption and arson. Q. The cops parked in our bar parking lot, facing the door, and watched customers exit this business, get into their car.
A: Entrapment is an officer inducing you to do something you wouldnt otherwise do. Which is not the caae here. However, simply leaving a bar parking lot is probably insufficient for a car stop. With other factors present it can be considered by the officer in forming reasonable suspiscion or probable cause. You may have a suppression issue but this is a dificult forum to give a complete analysis. Consult with a local attorney, its usually free and always confidential. They can give you a more complete analysis based on the actual facts and circumstances of your case.
Q. What can be used in defense of someone accused with providing false information to a police officer?
A: With all due respect... what? Not trying to be rude but there is literally no way of answering this question. You, very appropriately, try to keep the details sparse so you cant be identified but they are so sparse I can't fathom how you could hope to get a response. From what I gleaned, you have been charged with a crime, which you have been convicted of in the past. Call an attorney. You wont have to be sparse with the facts. They can confidentially, and often free of charge, analyze your case and answer your question in a meaningful way.
Q. Can a cop detain me in cuff in my own house when I was not violent or yelling; I was eating. They also injured me.
A: The problem with your question is that it lacks the context needed to answer. Why they were in your home matters. For instance, many police departments will cuff a person when they are executing a search warrant. Your simply stating "you are not violent" doesn't mean that you aren't. The other obvious answer is if they are arrestong you. So, as a practical matter, the answer is yes they can detain in you in your own home. As to whether the officer was aggressive or used more force than necessary I suggest you sit down and talk to a civil rights attorney. They know the questions to ask to properly assess whether you have a case or not.
