Ryan Hyde is an experienced criminal defense attorney and former prosecutor. In addition to handling hundreds of DUI cases through all stages of trial Ryan served as a DUI ARD Coordinator and as one of lead attorneys on Economic Crimes, Arson Crimes and Special Investigations Unit. Ryan has investigated and prosecuted dozens of complex economic crime cases, including securities fraud, political corruption and arson. As the deputy district attorney, Ryan gained insight into methods used against those charged with a criminal offense. Q. What should I do once the pfa order against me expires today? My husband lied in order to obtain to begin with.
A: I am not sure what you mean by your question. If the order has lapsed it no longer is in effect. Sounds like you still should avoid each other though.
Q. Can a D&A treatment program legally require you to stop taking perscription medication?
A: Any trace of marijuana in your system makes it illegal to drive. It is a per se DUI. So while Marijuana is rapidly legalizing the DUI laws are showing no signs of changing in that regards. Can a treatment program force you to stop taking marijuana is another matter entirely. Typical attorney answer, it depends. Realistically, a treatment program cannot force you to do anything. They can kick you out which can lead to a violation of your probation. Additionally, many probation departments do not allow prescription marijuana while on supervision. Q. What does it mean when it says sentence confinement other
A: Depends on the context in which it is written. It may mean a variety things. It may mean an alternative confinement such as house arrest or work release. Or it may mean probation in some circumstances. Your best bet is to contact a local attorney who will have experiences with the dockets in the particular county in which the entry was made.
