For almost 32 years, I have represented consumers and small business owners in lawsuits against insurance companies, insurance agents, banks, government entities, and attorneys. My practice is primarily focused on protecting people and businesses against insurance industry abuses. Over the years I have handled numerous cases involving non-payment or underpayment of homeowners claims and commercial property claims; insurers that refuse to defend liability claims; and insurers that unreasonably delay or deny uninsured motorist and automobile property claims.

- Q. We were denied our insurance claim when our trailer was stolen. They said we couldn't prove it was stolen
- A: Your testimony that your trailer was stolen is evidence that it was, so your insurance company is incorrect. You do have an obligation to file a police report within 24 hours after you discovered the theft, but obviously you cannot report what you don't know about. It sounds like your insurance company has breached the insurance contract, and committed bad faith. You should contact an attorney who specializes in insurance litigation.
- Q. Can a California Dr refuse to fill out paperwork required from EDD to process a disability claim w/o a fee?
- A: Some doctors do not want to get involved with disability claims, personal injury claims, or litigation and that is there choice. There is nothing you can do about it. Your only alternative is to go to a different doctor.
- Q. My car insurance company asked me to get an attorney because I have a claim against me in a fatal car accident.
- A: Its not clear what you are asking. Your insurance company has a duty to defend (retain a lawyer on your behalf) and indemnify you (pay any settlement or judgment up to the policy limit). If your insurance company is disputing coverage, you need an attorney who specializes in handling insurance coverage litigation. I suspect the issue may be that you have insufficient policy limits, which may set up a situation in which the plaintiff takes the case to trial and gets an excess judgment. If this is what is going on, you should retain independent counsel because your interests may conflict with those of your insurance company.
