- Q. In California, am I supposed to receive my final paycheck on my last day, even on a Sunday?
- A: The law in California is that if an employee quits, they are owed their final paycheck either during the next scheduled payday, or within 72 hours if the employee gives one pay period's notice.
You can just ask them to mail it to you.
- Q. If I own 50% of a business can the other partner sell their 50% to anybody even if I don't agree?
- A: It depends on the agreement between you two. If it is an LLC, there would be an operating agreement that would address this issue. If it is a partnership, there should be a partnership agreement that addresses what happens here.
You need to review the relevant documents and see what they say about transfers. Some of these documents have restrictions on transfers, some do not.
A full consultation would be necessary to properly advise you.
- Q. My business partner is avoiding me, how do I use my majority right to regain control of my business?
- A: Your rights here really depend on what the partnership agreement says and what powers it gives you as the majority partner.
It also depends on whether this is a limited partnership, an LLC, general partnership, etc.
A full consultation would be necessary to properly advise you.
