Sarah Schmeiser

Sarah concentrates on two areas of practice: criminal and traffic defense and immigration law. In the area of criminal and traffic defense, Sarah has defended clients at all levels - from local municipal courts through the Seventh Circuit Court of Appeals. Sarah handles many circuit court trials every year, successfully protecting client interests. Sarah handles all levels of appeal in criminal and traffic cases and has argued several cases in front of the Wisconsin Supreme Court.
Sarah frequently handles charges of drunk driving, sexual assault, substantial battery, theft from employer, delivery of a controlled substance, and all types of criminal and traffic offenses.
In the area of immigration, Sarah frequently handles family petitions as well as defending those in removal proceedings. Sarah often consults to provide information to clients and other attorneys about the immigration background and best plan for moving forward.

- Q. If Bond conditions state there's a no contact between two people can the person who is not on bond still send messages?
- A: Yes. If you are on bond for a crime and the Court orders you to have no contact with someone you are the one constrained, the other person is not. However, if there is an issue with this contact and you want it to stop, you may be able to take other action such as requesting a restraining order against the person so they cannot contact you.
- Q. For the purposes of an SBA loan application, is a DUI considered a "criminal offense"?
- A: A DUI is a criminal offense in all states except for Wisconsin. In Wisconsin a first offense DUI is usually a traffic ticket and not a criminal offense.
- Q. For a second 2nd dui, but the first was more than 10 years ago (in 2003) Do we have to install an interlock device.
- A: The law in Wisconsin does state that if you have a previous first offense DUI that was more than 10 years ago and you now have another first offense, you are required to have the ignition interlock device installed. In practical terms, if the information sent in to the Department of Transportation does not indicate an IID is required, installation will not be required.
