I am an expert in landlord tenant and real estate law, I have been practicing in NYC since 1971 and have been successfully helping residential and commercial tenants and landlords resolve their issues.

Besides being a lawyer, I am a native New Yorker and former Opera singer, I have recorded and performed internationally.Prior to opening this firm, I was a Senior Staff Attorney with the New York City Legal Aid Society and Special Counsel to the New York State Assembly. I have been featured on Tenant Talk Radio, represented thousands of individual tenants and property owners with a variety of real estate litigation issues.

Currently I am representing NYC tenants facing eviction due to the Covid-19 pandemic as well as lease negotiation and renewals, holdovers, succession rights, AirBnB issues, any dispute a tenant can have with a landlord I have handled.

Q. NYC Rent Stabilized Apartment - Succession Rights (see More Information)
A: From what you have said, it seems like it would be difficult to "win" a succession case in court. Although, an argument can be made that you were there as a caregiver for your mother, the problem being that when the court looks to determine succession they look for documentation such as tax returns, driver's license, pay stubs and if you are paying rent somewhere else.

However, it might be worth an inquiry to your landlord though a tenant lawyer such as ourselves to see if there is some room for discussion on this matter instead of going the court route.

Q. Hello! I recently moved out of an apartment in woodhaven, 1 year prior to the official lease ending.
A: Based on what you have described, we do not have enough information to answer this in full. But if you have left some occupant in the apartment who was not paying rent to anyone, you may still be liable for the rent, depending on what the facts. However if the occupant that you left in the apartment has been paying rent in his name you may have a defense that the landlord has acquiesced to his occupancy then you would not be liable. I suggest you call us or a landlord tenant attorney to fill the missing information needed to properly advise you.
