Q. My ex stopped paying alimony and now resides in Hawaii. What can I do from Texas?
A: You're going to need to start with a local attorney, as any pleadings would very likely need to be filed in the Court of original jurisdiction. I'd (or any attorney) need to see the original document before I could tell you what your options are. However, typically spousal maintenance is Ordered out of Chapter 8 of the Texas Family Code. You'd be advised to schedule a meeting to discuss your options.
Q. I had my husband served divorce papers and a Temporary Restraining order and he won't leave. What can I do ?
A: Typically restraining orders in this context are mutual and don't involve 'kick out' provisions unless specially pled for and granted. If you have a lawyer he or she should explain this to you up front. The good news is you accomplished service and you now have a pathway to proceed forward. Word or caution: he'll likely hire a lawyer. Most people confronted with legal documents of this nature do so. If you did the work so far, on your own I say congratulations but you'll also likely be dealing with an adversary with a law license going forward. Obviously I don't know you you should prepare for the worst.
Q. I got married in Puerto Rico I live in TX now, don’t know where he is how can I file for divorce?
A: You can accomplish a divorce by publication but it's hard to navigate without a lawyer. Also, as the wife you need to consider whether you've had children with someone else during his absence since your Husband is potentially the legally presumed Father under Texas law.
