Legal Answers
- Q. Can I be charged for fleeing and eluding if the officer never activated his lights or siren?
- A: Sure you can! You even admitted to it! And you were observed driving recklessly! You best chance now is to keep your mouth shut. You did have a right to remain silent. Say nothing further to anyone except to a local criminal defense attorney! Good luck!
- Q. I have a case of false witnesses against me. Should I take plea bargain with 12 months
- A: Those are super serious allegations! 12 months may be a a very good deal if you AND your lawyer think the allegations could prevail. Do NOT discuss this matter further with anyone but your lawyer! You do NOT want to be labeled a sex offender. It will negatively affect the rest of your life! Good luck!
- Q. Unsuccessful termination of felony probation?
- A: Perhaps is the most accurate answer I can provide. Much depends on the judge's temperament, how cooperative you've otherwise been with your PO and what the prosecutor view is of you. Do you have a significant criminal history? That will be very influential to the judge and prosecutor. I suggest that you get ahead of this after by securing a local criminal defense attorney who can file a motion to terminate probation BEFORE you are violated. This attorney can best plead your case to the judge. Don't wait on this or you'll likely be violated and waiting a month or more in jail for a hearing. Good luck!
