Q. I have a question about a Business Acquisition I'm making tomorrow in regards to liens and/or debt against the business.
A: Can’t agree more with Michael. Hire an attorney and run a lien search. Surely if you were buying a house you would run a search against judgments. Here you are buying a business and can be sued for its debts.

Sincerely,

Inna Fershteyn

Q. I found old will dated 2001 but a newer will was filed into probate in 2016 What do I do?
A: None. New will governs, old will is pretty irrelevant unless his other heirs want to contest the estate.

Are you trying to pass on your wealth to your descendants and loved ones? Do you want to manage your property and ensure that your family is taken care of? A trust may be the key to achieving your goals! What are trusts? Trusts are legal arrangements employed by individuals and families to distribute their assets in a fast and cost-efficient way. Why are they important? Trusts are important because they maintain the privacy of the grantor, the individual who sets up the trust, avoid probate, a costly legal process, provide management guidelines for beneficiaries, and protect the involved assets from creditors' claims. What are some examples of trusts and their basic purpose? There are various types of trusts that fulfill different purposes suited for specific financial situations. The two main trusts are the revocable trust and the irrevocable trust. A living trust, also known as a “Revocable Trust” allows the individual creating the trust to transfer the possession of assets included in the document, such as property, tangible goods, and intangible assets, to a beneficiary declared in the trust while still retaining ownership of the assets involved for a time. An Irrevocable Trust cannot be altered after it has been signed unless given permission by the beneficiary. After the proprietor’s death, the assets are given over to the trustee and beneficiaries with a tax-exempt status. What Type of Trusts Can Help Me Receive Public Assistance? A Pooled Income Trust allows you to receive public assistance benefits in addition to a steady monthly income from your trust. A Special Needs Trust preserves governmental benefits such as Medicaid and/or Supplemental Security Income (SSI) and protects the assets of a disabled person. The two main special needs trust are the First Party Special Needs Trust and the Third Party Special Needs Trust. How to set up a trust? First, you need to establish your reason for setting up a trust and decide who your beneficiaries will be. You will also need to name your trustee, who will ensure that your trust is upheld. These factors will determine which type of trust is suitable for your situation. Then, you will decide how you want your assets to be distributed to the beneficiaries, and fund your trust by transferring a variety of assets. Lastly, you can consult with a lawyer to create an investment plan for your assets. How can you maintain a trust? You need to make sure that your trust is updated by amending your trust when you want to change or add beneficiaries, change the disposition of assets in the trust, or redefine your trustees. An amendment to the trust must explain the changes, specify the additions or deletions, and be signed and dated. You shouldn’t revoke an old trust and make a new one with new information when making substantial changes. Instead, you should simply restate your trust with all the changes included, as this ensures that all assets will remain in the trust. Need helping setting up a trust?
