Legal Answers
- Q. Wrongful termination for using phone number for customer discounts in Ohio.
- A: Generally speaking, most retailers or grocery chains etc who allow customers to get points for shopping will have explicit policies about not using that points system for your own personal card or gain as an employee. Even if you didn’t know you signed a policy, courts generally assume that people have read the handbooks they sign. Ohio is an at will state, so no prior warnings are necessary, even if there was no written policy. Unfortunately, you are unlikely to have a strong wrongful termination claim, given the information you’ve offered, but consulting with an employment attorney is best as some facts not given here may change the analysis.
- Q. How can I legally address tip discrepancies in a mom-and-pop shop without HR?
- A: More information is needed to properly answer this, but generally, you should begin documenting everything if you haven’t already. Include dates/shifts worked, tips received v entered, communications with the employer / manager about your pay. Ask them directly what the process is, in writing, if possible. Something simple but not accusatory, like, “I’ve noticed inconsistencies with the tips recorded in my pay, like a $23 tip recorded as $20. Could I get a breakdown of how my pay is calculated per pay period for my records?”
If they’re shorting you on purpose, or you get no fix from confronting them head-on, you can speak with an employment attorney who handles wage and hour theft ... Read More
- Q. Can police take non-controlled medication during a traffic stop in Ohio?
- A: You should contact an attorney in your area who is familiar with local police custom, but you can first try the police department where the officers were dispatched from. It is not a violation typically for them to seize unbottled pills to verify them.
Depending on local practice, they may have you fill out a replevin form (they may call it something else) to request return of personal property. Everything removed from the stop should have been put in a chain of custody. If they don’t have it or are nonresponsive, it may be quicker to arrange with your doctor to have a refill ordered to your pharmacy.
