- Q. Can I file for TTD benefits while I work w/ a laywer to file workmans comp if my employer wouldn't report my injuries?
- A: Yes, you can. As long as you've reported the work-injury to your boss right away (and you have), you have up to three years to file a workers compensation case. Your employer can't file the case for you. All they can do is turn the matter over to their insurance company or not. Your next move is to hire an attorney experienced in Workers Comp who can get your case on file at the Commission. You can be sure they will turn it over to their insurance carrier once you've done that. You should be able to get TTD benefits, and you also should be able to get a settlement or award for your permanent partial disability.
- Q. How is a ptd settlement calculated in IL workers comp?
- A: As per the Illinois Workers Compensation Act, "In case of complete disability, which renders the employee wholly and permanently incapable of work, or in the specific case of total and permanent disability as provided in subparagraph 18 of paragraph (e) of this Section, compensation shall be payable at the rate provided in subparagraph 2 of paragraph (b) of this Section for life." In general terms, compensation at the rate of 2/3 your average weekly wage - subject to minimum and maximum rates - for life. These settlements are more complicated in practice, and are very rare.

- A: Sometimes. From the attorney, no, never. It is illegal for an attorney to advance money to a client as a loan against a case. However, there are licensed legal lending companies in Illinois that can do this. They evaluate the situation on a case-by-case basis. When they do issue a loan, the interest rates are high due to the risky nature of the loan. Your personal injury lawyer may work with these companies or may not, different lawyers feel differently about them.
