Q. I have a workers comp settlement awarded how much of that settlement can be garnished for back child support in SC
A: You are not going to like my answer but I believe 100% of it can be garnished for past child support. This is a big exception to the usual practice of no assignments on a worker's compensation settlement. I wish you the best. Carole
Q. When I file a complaint in the court of common pleas in SC, how long after do I have to wait to send my interrogatories?
A: Some people actually send the discovery requests with the complaint when it gets served. I would suggest waiting until they file an answer, wherein they will probably deny everything, and then send the interrogatories, request for production of documents and anything else you might want to send such as stipulations.
Q. My father was in an expensive nursing home in Massachusetts -- a nurse gave him Covid 19 and he died, can we sue them?
A: I am very sorry to hear of your loss. I agree with the other answer but I also wanted to share that you need to find an attorney as soon as you can, after doing your due diligence. You are going to need to subpoena a lot of documents and talk to the witnesses and get their deposition before their memory fades. There is no real benefit in waiting as you can always amend your complaint. The complaint and the filing of the complaint will allow your attorney to do the necessary discovery and depose the witnesses etc.
